Ripple v. SEC Settlement?
According to Marc Fagel, an SEC veteran and former Director, a ruling in the case between the United States Securities and Exchange Commission (SEC) and Ripple might soon be headed for trial. The former Director of the SEC’s San Francisco Office speculated on Twitter that he thinks a ruling might be coming in days.
Will The SEC Settle With Ripple?
Fagel stated that a “settlement wouldn’t be a legal precedent,“ but he argued that if there were a settlement to be had, “it seems like it would have happened already.“ He mentioned that “eve-of-trial” settlements are not unusual but noted that the impact of an injunction on future XRP sales could be difficult. In addition, he also said his „guess is a ruling is coming within days.“ Fagel further commented that there’s currently no basis for thinking that any delay of this case has anything „beyond the complexity of the case.“
Speech Materials Unsealed
Fagel mentioned that his point of reference was recently unsealed materials which seemed to suggest that the Court had already determined what its ruling would be. He believes some evidence will come out at trial rather than on summary judgment (SJ), suggesting some complexity with this issue.
Impact On Future XRP Sales
With regards to any potential settlement or injunction impacting future XRP sales, Fagel said this could only happen if Ripple accepted their tokens being classified as securities by regulators which hasn’t yet happened. Additionally, he noted how even if they did agree such classification it would take time for them to gain approval from other countries before being able to launch their product again legally worldwide.
The court decision on whether or not Ripple’s token should become classified as securities by regulators remains uncertain at this time. However according to Marc Fagel, who is an experienced industry veteran with great knowledge about security regulations, we may see a verdict soon enough as he believes it will come within days
